LEGAL NOTICE
VILLAGE OF KINGS POINT

NOTICE IS HEREBY GIVEN that a meeting will be held by the Board of Appeals of the Village of Kings Point at the Village Hall, 32 Steppingstone Lane, Kings Point, New York 11024, on June 24, 2024, at 7:00 p.m. The Board will immediately adjourn for advice of counsel and, at 7:30 p.m., the Board will commence public hearings for the consideration of the following applications and such other matters as may come before the Board:

CASE NO. PRBZA20240227- Application of Artin Sakhaee and Shirley Yaghoobian, as owners, with regard to the premises at 34 Martin Court, Kings Point, New York, which has two front yards, one on Sinclair Drive (north) and one on Martin Court North (south), for variances from the following sections of the Code of the Village of Kings Point:

1. § 94-14(C): to permit a garbage or refuse receptacle in a front (south) yard, when no garbage or refuse receptacles are permitted in a front yard.
2. § 140-5: to permit a swimming pool and its appurtenant equipment in a front (north) yard, when no swimming pools or its appurtenant equipment are permitted in a front yard.
3. § 161-23(A): to permit an accessory structure, a pergola, in a front (north) yard, when no accessory structures are permitted in a front yard. 4. § 161-34(A): to permit two curb cuts for a driveway or 22.3 feet and 21.5 feet, respectively, instead of the maximum permitted 20 feet.
5. § 161-36(E): to permit a retaining wall adjoining a property line, instead of the required minimum 6 feet from the property line.
The premises are shown on the Nassau County Land and Tax Map as Section 1, Block 150, Lot 18, and located in a Residence A2 zoning district of the Village of Kings Point.

CASE NO. PRBZA20240228- Application of 5 Horizon Way LLC, as owner, with regard to the premises at 5 Horizon Way, Kings Point, New York, for variances from the following sections of the Village Code for modifications to the first floor and a proposed second floor addition to a legal preexisting nonconforming dwelling:
1. § 161-10(A): to permit a front yard of 95.9 feet, existing, instead of the required 119.6 feet (a 25% variance).
2. § 161-30.1(A): to permit a floor area of 15,446 square feet, instead of the maximum permitted 11,321 square feet (a 37% variance). [there is a legal preexisting nonconforming floor area of 13,593 square feet. Owner seeks an additional 1,853 square feet.]
3. § 161-30.2: to permit a building area of 12,235 square feet instead of the maximum permitted 11,321 square feet (an 8% variance). [There is a legal preexisting nonconforming building area of 12,078 square feet.

Owner seeks an additional 157 square feet.]
The premises are shown on the Nassau County Land and Tax Map as Section 1, Block 140, Lot 42, located in a Residence A2 zoning district of the Village of Kings Point.

The applications and accompanying exhibits are on file in the office of the Village Administrator and may be inspected during normal business hours.

At said hearings, all parties in interest will be given an opportunity to be heard.
